2. Purposes and legal foundations of the processing

Following consultation of this site, data relating to identified or identifiable persons may be processed.

The personal data processed when browsing the site are intended for the following purposes:

  • the proper technical functioning of the site;
  • the management of information requests received from visitors by filling in electronic forms on the pages of the site, or via the email addresses of the offices and/or staff;

The legal foundation and lawfulness of the processing can be identified in the consent given for the processing of personal data. Please note that the data provided may be processed for the protection of legitimate interests of the data controller, including in particular the legal defense. Also in this, there will be applied the principles of necessity, proportionality and not excess.

However, it is always possible to ask the Data Controller to clarify the concrete legal foundation of each processing and in particular to specify whether the processing is based on law, provided by a contract or necessary to conclude a contract.

3. Types of data

By Personal Data we mean any information that could enable a person to be identified. In particular, by navigating on the site, the following may be collected:

Browsing data

The computer systems and software procedures used to operate this website acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes the IP addresses or domain names of the computers and terminals used by users, the URI/URL (Uniform Resource Identifier/Locator) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment. The data could be used to determine responsibility in the event of hypothetical computer crimes to the damage of the site.

Data supplied voluntarily by the visitor

This refers to all those personal data that the visitor freely releases on the Site, for instance, to register and/or access a reserved area, request information on a particular product or service via a form, or write to an email address.

4. Authorized persons, data processors and data recipients

Both navigation data and data voluntarily supplied by the user using the contact forms present on the site, or by writing email messages to the published addresses, may be processed by employees of the companies belonging to the Omninext Group, formally appointed by Omninext Holding S.r.l. as Data Controllers.

Omninext Holding S.r.l. guarantees that the processing of personal data of those who access the site (provided by email or electronic forms, including during registration) complies with the requirements of EU Regulation No. 679/2016.

5. Place and methods of processing

The processing of data takes place at the legal and operational offices of the company and is carried out by means of the operations indicated in Article 4 of the Privacy Code and Article 4 no. 2) GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Personal data are subject to both paper and electronic and/or automated processing.

6. Transfer of data to non-EU countries

The data provided will only be processed by persons authorized to process and appropriately instructed.

The data collected may be communicated to any companies connected to or employed by Omninext Holding S.r.l., which will use them for the same purposes for which they were collected.

The data may also be shared with third parties (Public Institutions, Police Forces), but only for the purpose of fulfilling legal, regulatory or EU obligations.

The data will be processed by the data controller within the territory of the European Union. In the event that issues of a technical or operational nature require the use of entities located outside the European Union, the transfer of personal data will be regulated in accordance with the terms of Title V of the European Regulation 2016/679. Therefore, all necessary cautions will be taken in order to ensure the most complete data protection, basing this processing: I) on appropriateness decisions of the receiving third countries expressed by the European Commission; II) on adequate guarantees expressed by the receiving third party pursuant to Article 46 of the European Regulation 2016/679; III) on the adoption of mandatory business rules.

7. Your rights

The data subject has the right to obtain from the data controller confirmation as to which personal data concerning him or her are being processed and, if so, to obtain access to the personal data and the following information:

  • the purposes of processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular if they are recipients in third countries or international organizations;
  • the planned period of storage of personal data or, if this is not possible, the criteria used to determine this period;
  • the existence of the data subject's right to request from the data controller the rectification or erasure of its personal data or the restriction of the processing of own personal data or to object to its processing;
  • the right to complain to a supervisory authority;
  • the existence of an automated decision-making process, including profiling, and, at least in such cases, meaningful information on the logic used, as well as the importance and expected consequences of such processing for the data subject.

Right referred to Article 17 of EU Reg. 2016/679 - right to erasure ("right to be forgotten")

The data subject shall have the right to obtain from the data controller the erasure of personal data concerning the data subject without unjustified delay, and the data controller shall be obliged to erase the personal data without unjustified delay if one of the following grounds applies:

  • personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the data subject withdraws the consent on which the processing is based in accordance with Article 6, paragraph 1), letter a) or Article 9, paragraph 2), letter a) and if there is no other legal foundation for the processing;
  • the data subject objects to the processing in accordance with Article 21, paragraph 1) and there is no overriding legitimate ground for processing, or objects to the processing in accordance with Article 21, paragraph 2);
  • personal data were processed illegally;
  • personal data must be erased in order to comply with a legal obligation under Union or Member State law to which the data controller is subject;
  • the personal data were collected in connection with the offering of information society services as referred to in Article 8, paragraph 1) of EU Reg. 2016/679

Right referred to Article 18 Right to restriction of processing

The data subject has the right to obtain from the data controller the restriction of processing when one of the following cases occurs:

  • the data subject contests the accuracy of the personal data, for the period necessary for the controller to verify the accuracy of that personal data;
  • the processing is unlawful and the data subject objects to the deletion of the personal data and requests instead that their use be restricted;
  • although the data controller no longer needs them for the purposes of processing, the personal data are necessary for the establishment, exercise or protection of a legal claim;
  • the data subject has objected to the processing pursuant to Article 21, paragraph 1), Reg EU 2016/679 pending verification as to whether the data controller's legitimate reasons prevail over those of the data subject.

Right referred to Article 20 Right to data portability

The data subject has the right to receive in a structured, commonly used and machine processable format the personal data concerning itself provided to a data controller and has the right to transmit these data to another data controller without any impediment from the data controller.

Revocation of consent to treatment

The data subject has the right to withdraw consent to the processing of its personal data by sending an express communication to the following address: info@omninext.it. Once this has been done, the personal data will be removed from the archives as soon as possible.
